Intellectual
Property Rights (IPR) InformationThe
Intellectual Property Rights (IPR) Form can be found as
'Page 5' of your Order Forms. It's an industry-standard
disclaimer where you state if you have the right to manufacture
the content on your CD or DVD master. Unfortunately the form is
a bit user un-friendly, so we will try to explain what each
section means.
1. Distribution:
Please type in the appropriate usage of your discs.
2. Declare the
country where the distribution will take place.
3. If your
shipping destination is in the USA you must provide the Employee
Identification Number, Federal Sales Tax Number or Social
Security Number of the person *receiving* the shipment at it's
destination. This is a U.S. governmental requirement of the
Customs Service which is intended to reduce the shipment of
illicit materials into the USA. CDman has no control over this
governmental requirement. Please note that we do not
electronically store this information.
4. If you own all
of the content on your CD or DVD, then this form is very easy to
complete from this point forward. Simply check the
"YES" box and then sign the bottom of the form...
that's it... you can ignore Sections 5, 6 and 7 if you are the
Intellectual Property Rights holder of the content of the disc.
5. If you are
ordering data discs (CD-ROM or DVD-ROM) and you are NOT
the Intellectual Property Rights holder for all content on your
master, you will need to:
- Include the
names of any files that you do not own (eg: quicktime.exe).
- Include a
print-out of your mechanical license from the 3rd party on a
separate piece of paper. Additional information is provided
on our Licensing page.
6. If you are
ordering audio/music discs and your are NOT the Intellectual
Property Rights holder for all content on your master, you will
need to:
- Include the
name of the publisher for each song.
- Provide proof
of mechanical licensing for any cover songs.
- Provide proof
of master licensing for any 'samples' (of any
duration).

(in the USA) or www.cmrra.ca
(in Canada).

7. If you are
ordering CDROM or DVD discs that include video files and you are
NOT the Intellectual Property Rights holder for all content on
your master, you will need to:
- Include the
name of the Intellectual Property Rights holder for each
video.
- Provide proof
of licensing for each video used.
8. The bottom of the
form simply asks for your company name, your printed name and
title, your written signature, and the date. This
information is used to declare ownership and that
you understand the terms and conditions outlined on Pages 6 and
7 of your Order Forms.
Please be sure
that you have read and understand
your legal obligations before you commit to an order. You must
either own the right to copy the material you are submitting, or
you must be able to provide proof of licensing that gives you
the right to copy the
material you are submitting. It is ILLEGAL to
copy Intellectual Property that you do not own or have the rights for.
