"Made In Canada" for Shipments To The USA:

The North American Free Trade Act (NAFTA) allows for the shipment of manufactured CDs and DVDs between the United States and Canada without any duties or tariffs (hence "free trade"). However, there is a requirement whereby the country-of-manufacture must be legible on the outside of each packaged product. 

CDman is located in Canada and, due to the country-of-manufacture requirement, products shipping from CDman into the United States must show the exact phrase "Made in CA" or "Made in Canada". The disc art or inside panels of your design do NOT need to be included.

This requirement is only applicable for final RETAIL packaging. If your project is not in final retail packaging (eg: bulk or paper sleeved), you are NOT required to include Made In Canada.

If you plan on shipping your discs south of the border and beyond, you must include the words "Made In Canada." Here is the US law in abbreviated form:

Sec. 134.46 Marking when name of country or locality other than country of origin appears.

In any case in which the words "United States,'' or "American,'' the letters "U.S.A.,'' any variation of such words or letters, or the name of any city or location in the United States, or the name of any foreign country or locality other than the country or locality in which the article was manufactured or produced appear on an imported article or its container, and those words, letters or names may mislead or deceive the ultimate purchaser as to the actual country of origin of the article, there shall appear legibly and permanently in close proximity to such words, letters or name, and in at least a comparable size, the name of the country of origin preceded by "Made in,'' "Product of,'' or other words of similar meaning.

  • "Made In Canada" will need to appear on the outside of the finished wrapped product. Typically this means the traycard (back piece of a jewel case) - or the rear panel of a cardboard mailer or software box or Digipak. It does *not* need to appear on the actual disc design or inside of the packaging. A customs officer picks up a sample of the shipped product and will look for "Made In Canada" without removing any shrink wrap.
  • If you include a U.S. address (ie: a distributor or your home) "Made In Canada" must appear within 1" of the address in the same size and color as to not obscure the fact that the CD was made in Canada.
  • "Printed", "Pressed", "Duplicated" or "Assembled" are not acceptable replacements for the word "Made"
  • "Made In Canada" must be clearly legible without obscuring the text. Sufficient contrast between the background and the lettering is required.

    Tip: You could include the phrase: "recorded, mixed, edited or authored in the U.S." in addition to Made In Canada to help clarify what is what.

What about non-final packaging or Bulk CDs?

"Made In Canada" does not need to appear on any non-final packaging or bulk CDs in envelopes or on spindle. Please read and understand the following criteria and then submit the PDF form found below or use the one found inside our order forms in the store section of this web site. DO NOT use the form below if ordering jewel boxes with shrink-wrap.
